1. Scope and Provider
These Terms and Conditions (“Terms”) govern all purchases made from and services provided by:
Veristone e.U.
Villacher Str. 75b
9220 Velden am Wörthersee, Austria
VAT ID: ATU83098167
Email: info@veristone.eu · Phone: +43 664 1482753 · Website: https://veristone.eu/
These Terms apply to all orders placed through our website, in our showroom, or by other means of communication (e.g. email or phone), whether by consumers or business customers, unless otherwise agreed in writing. By placing an order, you accept these Terms.
2. Products and Descriptions
We make every effort to describe and depict our jewellery, gemstones and related products as accurately as possible, including weights, measurements, and any accompanying certification. Due to the nature of natural materials and handcrafted items, minor variations in colour, size, and appearance between the product shown and the product delivered may occur and do not constitute a defect. Product images are for illustrative purposes and colours may vary slightly depending on display settings.
3. Conclusion of Contract
The presentation of products on our website or elsewhere does not constitute a binding offer, but an invitation for you to place an order. By submitting an order, you make a binding offer to purchase. A contract is concluded only once we confirm acceptance of your order in writing (e.g. by order confirmation or invoice email), or once we perform the requested service.
We reserve the right to decline an order, in particular in cases of pricing errors, unavailability of stock, or reasonable doubts as to the customer’s identity or creditworthiness.
4. Prices and Payment
All prices are quoted in Euro (EUR) and, unless stated otherwise, include statutory Austrian VAT. Shipping, insurance, and any customs or import duties for deliveries outside Austria are additional and will be shown before an order is completed, where applicable.
Payment is due at the time specified during checkout or as otherwise agreed (e.g. deposit for custom or bespoke pieces, balance on completion). Accepted payment methods are shown at checkout or communicated directly. Ownership of the goods passes to you only once payment has been received in full (retention of title).
5. Delivery
We aim to deliver within the timeframes indicated at the time of order. Given the nature of certified, bespoke, or sourced items, delivery times for such products may be longer and will be communicated individually. Risk of accidental loss or damage passes to consumers upon delivery of the goods to them or a person designated by them; for business customers, risk passes upon handover to the carrier, unless otherwise agreed.
High-value shipments are typically sent insured and with signature required. We are not responsible for delays caused by customs processing, incorrect delivery details provided by the customer, or events beyond our reasonable control.
6. Right of Withdrawal (Consumers)
If you are a consumer contracting from within the EU, you generally have the right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason, in accordance with the Austrian Fern- und Auswärtsgeschäfte-Gesetz (FAGG). To exercise this right, please notify us in writing (e.g. by email) of your decision to withdraw before the deadline expires.
Please note that the right of withdrawal does not apply to goods made to your specifications or clearly personalised (for example, custom-designed or engraved jewellery), and may not apply to sealed items that are not suitable for return for health or hygiene reasons, once unsealed. Returned goods must be complete, in their original condition, and accompanied by any certification provided. We reserve the right to reduce the refund to account for any diminished value resulting from handling beyond what is necessary to establish the nature of the goods.
7. Warranty and Liability for Defects
Statutory warranty rights (Gewährleistung) apply as provided under Austrian law. For consumers, the statutory warranty period is two years from delivery. If a product is defective, you are entitled to repair, replacement, price reduction, or, in certain circumstances, cancellation of the contract, in accordance with applicable law.
This warranty does not cover damage resulting from normal wear and tear, improper use or care, unauthorised repairs or alterations, or accidental damage after delivery. Any manufacturer’s or supplier’s guarantee, where offered, is provided in addition to, and does not limit, your statutory rights.
8. Certification and Valuations
Where a product is sold with a gemmological certificate, appraisal, or grading report from an independent laboratory, that document is provided by the relevant third party. We take reasonable care in sourcing such reports but are not the issuer of, and cannot guarantee the findings contained in, third-party certification.
9. Liability
We are liable without limitation for damage caused by intent or gross negligence, for injury to life, body or health, and under any applicable product liability law. For damage caused by slight negligence, our liability is limited to foreseeable, contract-typical damage. This limitation does not affect any statutory warranty rights described in Section 7.
10. Intellectual Property
All content on our website and marketing materials, including designs, photographs, text, and logos, is protected by copyright and other intellectual property rights and may not be reproduced or used without our prior written consent.
11. Complaints and Online Dispute Resolution
If you have a complaint, please contact us using the details in Section 1 so we can try to resolve it directly. Consumers within the EU may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obliged, and do not commit, to participate in dispute resolution proceedings before a consumer arbitration board.
12. Data Protection
Personal data provided in connection with an order is processed in accordance with our Privacy Policy, available on our website.
13. Governing Law and Jurisdiction
These Terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence.
For disputes with business customers, the competent court shall be the court with subject-matter jurisdiction over the seat of the company in Austria. For consumers, the statutory rules on jurisdiction apply.
14. Final Provisions
Should any provision of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. We reserve the right to amend these Terms at any time; changes will apply to orders placed after the amended Terms take effect.
